Residents will fight Quikrete
Homeowners may file an appeal with state board

Webb Lake Homeowners Association of Silverton has taken the first step toward fighting the controversial Quikrete application, filing an appeal with the Land Use Board of Appeals.

Community Development Director Steve Kay said the group filed a notice of intent to appeal earlier this month.

Since then, all documents related to the application have been sent to LUBA, Kay said.

Now the homeowners group's attorney will review the record and decide if they want to proceed with the appeal and on what grounds specifically.

"The city and Webb Lake Homeowners are kind of in a holding pattern as to how to proceed," Kay said.

The application to establish a concrete packaging plant at the former Redman Housing plant at 1204 Mill St. prompted multiple protests and three earlier appeals, filed by Citizens United Against Quikrete, Webb Lake Homeowners Association and Quikrete.

In November, the city council finalized its approval of the application. In the process, the council decided to eliminate two of the 31 the conditions — one that would require enclosure of equipment and another that deals with nighttime noise and hours of operation — that had previously been set by the planning commission.

Officials had anticipated then that the application would be appealed to LUBA.

Kay said that Webb Lake is the only group that intends to file an appeal with LUBA. If they pursue the appeal, he said a decision by LUBA would be made in the next couple of months. Officials could choose to remand the decision back to the city or it could be reversed, he said.

"The city will just have to wait and see if a petition for review is filed," Kay said.

If that happens, the city will have a chance to submit a respondent brief to LUBA, explaining why it disagrees with the appeal.

Calls placed to Webb Lake Homeowners Association were not returned as of press time.

Jobs

Sure looks like we could have used some of the jobs that Quikrete was going to bring to Silverton. A spaghetti dinner can never replace the steady jobs that Quikrete would have brought us. The working class was denied an opportunity that in today's economy rarely comes along. We will all pay the price for the hysteria that overtook some and the opportunity for political advancement that drove others.

18 jobs? Yah better then none, but I bet 5 of them would have been filled by corp. positions from out of state. So thats 13 jobs... This is another reason why IMHO Quikrete was the wrong solution for our town... Unfortunately due to the economy I am not sure how long it will be before a business fills in there...
